Professional Liability Insurance

Registered social workers require professional liability insurance coverage as per the Health Professions Act (s. 28(1c). Insurance must be updated in the Alberta College of Social Workers (ACSW) member profile annually. For RSWs who are employed, this requirement can be met through your employer's malpractice insurance coverage; however, it is recommended that RSWs obtain their own coverage. ACSW does not specify a minimum amount, type, or provider of professional liability insurance.

What is Professional Liability Insurance?

Professional liability insurance is required to protect social workers from loss against claims of negligence, malpractice, mistakes, or misrepresentation. It can also be called errors and omissions insurance or malpractice insurance. 
Depending on the type of coverage obtained, it can include:

  • legal expenses;
  • settlements or damages; and/or
  • loss of earnings

As professional liability insurance plans may differ, it is best practice to research which plan fits best for your social work practice. For example, certain insurance companies may only cover services rendered in your home province or have additional conditions for electronic/virtual practice.


RSW Purchased Versus Employer Provided

An employer's malpractice insurance protects the employer, consequently, protection to employees is incidental. It is important to understand the limitation of the employer's professional liability coverage. For example, if the social worker is found individually responsible for an error, omission, or negligent act, this may not be covered through their employer's insurance. In this case, any financial costs may be the responsibility of the social worker. An RSW should consider personal risks in relation to their professional practice and personal goals. RSWs are encouraged to discuss with their employer professional liability coverage and how they are protected. Many employer's insurance coverage does not cover employees if there is regulatory disciplinary action and/or investigations. In a regulated profession, an RSW is accountable to the highest standards that go beyond their employer. While ACSW allows social workers to use their employers liability insurance, it is recommended that each RSW carry their own coverage.

Practicing as a Volunteer

Many social workers practice in volunteer capacities instead of being employed or in addition to being employed. Those in volunteer capacities also require professional liability insurance. RSWs can provide their own liability insurance or have their agency provide liability insurance. 

Supervising Students

Professional liability insurance is an important protection mechanism for social workers. At a potential cost, it can be extended to protect against errors, omissions, or negligence by a social work student. During this critical stage in their learning journey, students may make mistakes. To reinforce assurance and a peace of mind, insurance can protect a social worker and their student should a malpractice complaint result. Discuss professional liability insurance policies with your students' educational institution.

Where to get Professional Liability Insurance?

RSWs may purchase and secure professional liability insurance from any reputable insurance provider of choice. Professional associations may offer insurance programs with preferred rates for association members.
